[Constitution Day Event] “All arms of the Government must remain vigilant of duty to Constitution” – SCBA chief Kabil Sibal

He emphasized the role of constitutional courts in maintaining power balance and preventing government excesses. Bar Council Chairman Manan Kumar Mishra highlighted the misuse of fundamental rights, calling for judiciary-government collaboration to uphold constitutional principles.

New Delhi: At the 75th Constitution Day celebrations held in the Supreme Court, Supreme Court Bar Association President Kapil Sibal emphasized that “it is the public which is central to a republic and not the state apparatus.” Addressing the gathering, he urged that all arms of government, including courts, must remain vigilant in upholding their constitutional duties.

Sibal highlighted the critical role of constitutional courts in maintaining the balance of power. He stated,

“Constitutional courts play the role of reminding the government of the ‘centrality of the public in our republic.’ They check disproportionate action and prevent government excesses.”

He also acknowledged the collaborative responsibility of the bench and the bar in preserving these ideals.

Adding to the discussion, Bar Council of India (BCI) Chairman Manan Kumar Mishra drew attention to the “shameful and dangerous misuse” of fundamental rights provisions under Part III of the Indian Constitution by some politicians. He called on the judiciary, particularly the Supreme Court and high courts, to work with the central government to address this issue effectively.

Mishra’s remarks and Sibal’s insights underline the importance of a vigilant judiciary and responsible governance in ensuring that the principles of the Constitution are upheld.
