The bail hearing for Atul Subhash’s wife, Nikita Singhania, is scheduled for January 4 in a Bengaluru court. Her bail application was submitted on Monday, and her counsel argued against granting bail to her and the other accused involved in the case.
Counsel for Atul Subhash’s family emphasized,
“The criminal nature of this case is escalating, and she cannot exploit the child. We are seeking full custody of the child.”
He added,
“The crime committed is extremely serious. We have also filed a habeas corpus petition with the Supreme Court, which has directed the states of Uttar Pradesh, Karnataka, and Haryana to locate the child. Once the child is found, the court will decide on custody matters.”
He stated,
“Why was the 4-year-old child living away from his mother in a hostel? The grandparents are concerned about their grandchild,”
Pavan Kumar Modi, Atul Subhash’s father, expressed his family’s fears regarding the safety of Atul’s child. He warned,
“If the court grants bail to Atul’s wife, she could pose a threat to the child’s safety. If she could drive my son to suicide, she could do the same to the child.”
He stated,
“My grandson was like an ATM for her. She received money under the guise of caring for him. She approached the High Court demanding between Rs 20,000 and Rs 40,000, and then went on to request Rs 80,000. Even after that, her demands continued to escalate. Therefore, we have approached the Supreme Court for custody of the child, as he is safe with us,”
Bikas Kumar, brother of Atul Subhash, expressed satisfaction with the police investigation,
“The police have supported us, and we have met their requirements for the ongoing investigation. We are focused on gaining custody of the child, and we have informed our advocate about this. The matter is currently before the Supreme Court.”
When asked about the child’s current location, he replied,
“We do not know where Atul’s son is. We are awaiting the January 7 hearing in the Supreme Court regarding this issue.”
Atul Subhash, who worked for an automobile company in Bengaluru, allegedly took his own life after being pressured for a Rs 3 crore divorce settlement. He ended his life in his apartment early on December 9, leaving behind a 90-minute video and a 40-page death note detailing how the harassment from his wife, Nikita Singhania, and her family led him to this tragic decision.
Three individuals in connection with Atul Subhash’s suicide his wife, her mother, and brother were arrested by Bengaluru Police and have been placed in 14-day judicial custody.
An FIR was filed against the accused under Sections 108 and 3 (5) of the Bharatiya Nyay Sanhita (BNS) on December 9, following a complaint by Bikas Kumar, who alleged abetment of suicide at the Marathahalli police station in Bengaluru.
In his complaint, Bikas alleged that false cases were lodged against his brother by the accused, who demanded Rs 3 crore to settle the matter. He also claimed that during court proceedings, his brother was taunted to either pay the amount or face the consequences of suicide.
Nikita’s family has countered by alleging that Atul Subhash demanded a substantial dowry from them, which they claim contributed to the death of her father.
