BREAKING | Delhi Court Rejects Arvind Kejriwal's Plea for Medical Consultation via VC in Tihar Jail

DELHI: Today(on 22nd April), A Delhi court has dismissed Delhi Chief Minister Arvind Kejriwal’s plea requesting permission to consult his doctor for 15 minutes every day via video conference. However, the court has directed the Tihar Jail authorities to ensure that Kejriwal receives the necessary medical treatment.

In the case of specialized treatment, the jail authorities are instructed to seek the advice of a medical board constituted by the Director of All India Institute of Medical Sciences (AIIMS).

The plea filed by Kejriwal not only sought directions for daily consultation with his doctor but also requested the administration of insulin. The Enforcement Directorate (ED) opposed the plea, claiming that Kejriwal deliberately consumed mangoes, sweets, and other food items in his home-cooked meals to artificially spike his sugar levels and subsequently use it as a ground for bail.

According to the ED, the home-cooked meals consumed by the Delhi Chief Minister in jail differed from the prescribed diet recommended by doctors.

Zoheb Hossain, the Special Counsel for the ED, suggested that Kejriwal should be examined by doctors from AIIMS.

On behalf of Tihar Jail, Advocate Yoginder Handoo argued that AIIMS’ opinion was sought regarding the matter, and the doctors advised against diabetic patients consuming mangoes. Handoo further contended that Kejriwal’s sugar levels were stable, and there was no requirement for insulin.

Senior Advocate Abhishek Manu Singhvi, representing Kejriwal, refuted the allegations made by the ED and Tihar Jail. Singhvi highlighted that out of the 48 meals sent from Kejriwal’s home, only three contained mangoes, and he had consumed aloo puri (potato bread) once due to the occasion of Navratri. Singhvi emphasized that minor deviations in the diet should not be used as a basis to oppose the application for insulin.

Singhvi expressed his disappointment with the ED’s stance, describing it as “petty, political, and ridiculous.” He emphasized Kejriwal’s right to a dignified life and access to proper healthcare as an undertrial prisoner. Singhvi further criticized the investigating agency, stating that despite 75 years of democracy, he had not witnessed such pettiness before.

The senior advocate also addressed the false and malicious statements made by the ED, stating-

“I only use sugar-free in my tea. It’s astonishing how trivial, political, and absurd ED can be. Their claims are entirely unfounded and malicious. Just because they wield considerable influence in the media, they manage to spread false information about me enjoying aloo-puri, even though I only received this meal once during Navratri.”

The court’s decision to reject Kejriwal’s plea for daily doctor consultation while ensuring the provision of necessary medical treatment reflects a balanced approach. It acknowledges the importance of Kejriwal’s health while considering the recommendations of the medical board from AIIMS.
