Delhi HC Allows Video Conferencing in 498A/406 Probe: “Repeated Summons Amount to Harassment & Abuse of Process of Law”

NEW DELHI: The Delhi High Court on September 15, 2025, has recognised that repeated summons to an accused, despite his cooperation, may amount to harassment. The Court has allowed the petitioner, Mr. Kushal Agarwal, facing proceedings under Sections 498A and 406 of the IPC, to participate in further investigation through video conferencing instead of making repeated physical appearances.

The matter was argued by Adv. Rattandip Singh, along with Adv. Divya Tripathi and Adv. Pritha Khanna from Tripaksha Litigation, appearing for the petitioner.

The Petitioner’s Submissions

Placing the grievance before the Court, the petitioner’s counsel highlighted that Mr. Agarwal had already:

Counsel submitted that forcing the petitioner to undertake repeated journeys despite such cooperation was nothing short of harassment and an abuse of process. In today’s digital age, counsel argued, further cooperation could be effectively ensured through video conferencing without unnecessary hardship.

The Court’s Findings

Justice Arun Monga, while disposing of the writ petition, observed that:

“The petitioner has already appeared in person as many as three times by travelling from Kolkata and got his statement recorded. The respondents are directed to allow the petitioner to join further investigation through video conferencing.”

The Court, however, also issued a note of caution:

“This order shall not in any manner be construed to impede the intended investigation by the IO.”
