The Punjab and Haryana High Court refused to hear a PIL seeking action against illegal immigration, stating authorities must address the issue first. This comes as US military planes deport hundreds of Indians, including many from Punjab and Haryana.

US Deportations | 'Curb Illegal Immigration From India To Other Countries': Punjab and Haryana HC Rejects PIL

CHANDIGARH: The Punjab and Haryana High Court refused to consider a Public Interest Litigation (PIL) that asked for steps to stop people from illegally going to other countries from India.

The Division Bench, led by Chief Justice Sheel Nagu and Justice HS Grewal, said that the authorities should handle this matter before the Court steps in.

“The grievance alleged is of rampant illegal immigrants being sent abroad through illegal means in violation of certain provisions of the Emigration Act, 1983. It would be appropriate that the competent authority under the said Act of 1983 deals with the issues before this Court enters upon the process of adjudication,”

-the Court said.

The Court then directed the petitioner to first approach the authorities with their complaint.

“The petitioner is directed to prefer representation raising all the grievances as raised herein, which if done, within a period of 30 days shall be considered and decided by respondents No.1 to 3 as expeditiously as possible by passing a speaking order and the outcome shall be communicated to the petitioner,”

-the Court ordered.

The PIL was filed by Kanwar Pahul Singh, who requested that Emigration Check Posts be set up in every district of Punjab. This would help regulate the emigration process and take action against travel agents involved in illegal immigration.

This case was filed at a time when three US military aircraft had already landed in Amritsar with many deported Indian citizens who had entered the USA illegally. The deported individuals were from Punjab, Haryana, Gujarat, Chandigarh, and other states.

Kanwar Pahul Singh appeared in Court himself.

Additional Solicitor General Satya Pal Jain, along with Senior Panel Counsel Dheeraj Jain, represented the Union of India.

Senior Deputy Advocate General Salil Sabhlok appeared for the State of Punjab.
