The Delhi High Court has directed the Director of AIIMS to constitute a medical board to verify if Jaideep Singh Sengar, convict in the Unnao custodial death case, is truly suffering from cancer. This follows his request for a jail sentence extension.

The Delhi High Court instructed the Director of the All India Institute of Medical Sciences (AIIMS) to form a medical board to assess whether Jaideep Singh Sengar, a convict in the Unnao custodial death case, is actually suffering from cancer as he claims in his request for an extension of his jail sentence.
Earlier, On February 24, a Division Bench consisting of Justice Navin Chawla and Justice Ravinder Dudeja addressed Sengar’s plea for an interim suspension of his sentence on health-related grounds.
Sengar, the brother of expelled BJP legislator Kuldeep Singh Sengar, was convicted in March 2020 by a Delhi court for his involvement in the custodial death of the father of the Unnao rape survivor.
Sengar has asserted that he is battling Stage-IV oral cancer with suspected recurrence, along with osteoradionecrosis, trismus, and a chronic jaw infection. He mentioned undergoing surgery at AIIMS in October 2020 and stated that he requires specialized treatment unavailable in prison.
Conversely, the Central Bureau of Investigation (CBI) contested the plea, presenting a detailed verification report dated February 20, 2026. The agency informed the Court that many of Sengar’s medical documents and prescriptions were found to be forged after confirming their authenticity with relevant hospitals and doctors.
They highlighted that one prescription he presented actually belonged to a different patient.
While some of Sengar’s past treatment records seemed genuine, the CBI argued that there was no credible evidence to prove he is currently suffering from Stage IV cancer.
The counsel for the victim also opposed the application, indicating that the medical documents had not been accurately verified and alleging previous misuse of the liberties granted to Sengar.
Recognizing the severe discrepancies surrounding the legitimacy of the medical records, the High Court stated,
“In matters concerning suspension of sentence on medical grounds, the Court must be guided by reliable and objective medical opinion and documents.”
The Court concluded that an independent assessment by a properly formed medical board was essential to ascertain Sengar’s current health status.
Consequently, it directed the Director of AIIMS, New Delhi, to establish a medical board to conduct a thorough evaluation of Sengar and report whether he is suffering from cancer or any other life-threatening illness, and if so, at what stage.
The board was also tasked with determining whether the necessary treatment could be sufficiently provided within the jail hospital or through accompanied visits to government hospitals.
The Jail Superintendent was instructed to present Sengar to the medical board on February 26 and to ensure that all pertinent medical records are provided.

The case will be reviewed again on March 2, 2026, after the medical board submits its findings.
Senior Advocate Pramod Kumar Dubey, along with advocates SPM Tripathi, Hemant Shah, Satyam Sharma, Saurabh Pal, Yash Saxena, Samarth Kasana Panwar, Saurav Rajput, and Aswariya Singh, represented Sengar.
The CBI was represented by Special Public Prosecutor Anubha Bhardwaj alongside advocates Ananya Shamshery, Anchal Kashyap, Mayank Bawa, Riddhi Grover, and Vijay Misra. The victim/complainant was represented by advocates Mehmood Pracha, Jatin Bhatt, and Kshitij Singh.
