"Strange" Trend of Bail : SC Slammed Patna High Court Order to Grant Bail After 6 months

A Bench comprising Justices Abhay S. Oka and Augustine George Masih was hearing an appeal against a Patna High Court order, which stipulated that a murder accused would be released on bail after six months.

NEW DELHI: Today (12th July): The Supreme Court criticized the trend of High Courts issuing conditional bail orders that delay the effectiveness of the bail by six months to a year, as seen in the case

A Bench comprising Justices Abhay S. Oka and Augustine George Masih was hearing an appeal against a Patna High Court order, which stipulated that a murder accused would be released on bail after six months.

The Supreme Court found this practice problematic.

“This is extremely strange. Some courts are granting bail for 6 months or 1 year and this is a new trend now. It is like saying I am granting you bail but will release you after 6 months. What is this,”

the Court remarked.

The Court then granted interim bail to the accused and requested the Bihar government to respond by September 2.

The Bench was reviewing an appeal against an April 19 order from the Patna High Court issued by Justice Dr. Anshuman.

The contested order stated:

“Let the petitioner Jitendra Paswan … be released on bail, but after six months from today, on furnishing bail bonds of Rs 30,000 with two sureties of the like amount each.”

Dissatisfied with this decision, the accused approached the Supreme Court through advocate Satya Mitra.
