‘Arbitrary’ Selection Process: HC Quashes Appointment of 935 Constables in Nagaland; Orders Fresh Recruitment

Gauhati: The Kohima Bench of the Gauhati High Court invalidated the appointments of 935 police constables in Nagaland, pointing out irregularities in the hiring that occurred from January 2018 to October 2019.

Justice Devashis Baruah, who issued the verdict on Friday(20th Sept), directed the state government to initiate a new recruitment process.

This order followed a writ petition from several unemployed youth contesting the state government’s method of appointment, which was made without a public advertisement.

The petitioners referred to these appointments as “backdoor appointments” and claimed that the selection process was arbitrary.

The Court instructed the state government to launch a new recruitment process for fresh selections by advertising the positions in widely circulated local newspapers.

According to the order, this new recruitment must comply with legal standards and be completed as soon as possible, within six months.

The court also permitted a relaxation of the upper age limit for both the petitioners and the previously appointed individuals during the new recruitment process, while insisting on strict compliance with basic qualifications and physical examination standards.

Additionally, it allowed the state government to let the quashed appointees remain in service for six months from the date of the judgment or until new appointments are made.
