Rahul Gandhi Moves Jharkhand High Court to Cancel Non-Bailable Warrant Issued by Chaibasa Court

Rahul Gandhi Moves Jharkhand High Court to Cancel Non-Bailable Warrant Issued by Chaibasa Court

RANCHI: Congress leader and Leader of Opposition Rahul Gandhi has filed a legal petition in the Jharkhand High Court. He wants the court to cancel the non-bailable warrant recently issued against him by the Chaibasa court.

His lawyer, Dipankar, told media,

“The petition was filed on Thursday.”

This warrant was issued by the Chaibasa court after Rahul Gandhi failed to appear in person, even after earlier notices. The court had asked him to come on June 26. Earlier, a petition was already filed in the Jharkhand High Court asking that Rahul Gandhi should not be forced to appear in person at the Chaibasa court. But instead of waiting for that petition to be decided, the Chaibasa court issued a non-bailable warrant.

In the new petition filed, Rahul Gandhi’s lawyer has clearly said that this was not proper. He has requested the High Court to cancel the warrant. The petition also says that the earlier exemption request is still pending and should have been considered first.

Currently, the High Court is on summer vacation. Even then, Rahul Gandhi’s legal team is trying hard to get the petition heard quickly. Right now, there are two legal cases going on against Rahul Gandhi in Ranchi and one in Chaibasa.

The Chaibasa case is about something Rahul Gandhi said during a Congress meeting on 28 March 2018. At that time, he had made a statement about BJP, and because of that, BJP leader Pratap Kumar filed a defamation case against him.

In February 2020, the Jharkhand High Court ordered this case to be transferred to the special MP-MLA court in Ranchi. But later, the High Court again moved the case to the special court in Chaibasa.

Even after getting court summons, Rahul Gandhi did not attend the hearing. Because of this, the court first issued a bailable warrant. But again, when he didn’t appear, the court had to issue a non-bailable warrant.

That non-bailable warrant was earlier challenged in the High Court, but it was disposed of. After that, Rahul Gandhi’s legal team filed another petition under CrPC 205, which allows a person to ask for exemption from appearing personally in court. But the lower Chaibasa court rejected this request.

In another legal matter, Rahul Gandhi also had a case in the Ranchi court related to his statement on the “Modi surname” controversy. In that case, the Jharkhand High Court has already given him exemption from personal appearance.

Also, in a second Chaibasa case involving comments made against BJP and Union Minister Amit Shah, Rahul Gandhi has received a stay order from the Supreme Court.
