Patna High Court Warns DM: “Remove Illegal Encroachments in 4 Weeks or Face Contempt Action”

The Patna High Court strongly warned DM Dr. Tyagarajan S.M. to remove illegal encroachments in four weeks. The bench said if not done, it would be seen as defiance of court orders, leading to contempt action.

The Patna High Court took a strict stand on the problem of large-scale encroachments in Patna and gave a strong warning to District Magistrate Dr. Tyagarajan S.M.

A Division Bench, consisting of Justice P.B. Bajanthri and Justice S.B.P. Singh, made it clear that if the illegal encroachments are not cleared within four weeks, it will be assumed that the DM is disregarding the court’s orders, prompting the initiation of contempt proceedings against him.

This directive arose from the case of Dr. Amit Kumar Singh vs. State Government, where the petitioner claimed that the administration’s assertions about removing encroachments were merely superficial, contrasting sharply with the actual situation on the ground.

The court instructed the DM to record the encroachment removal process using digital photography (including date and time) and to present this documentation to the court before the next hearing.

Additionally, a copy must be provided to the petitioner.

Making sharp remarks, the court stated that the matter has been unresolved for five years and further delays are unacceptable.

If the administration cannot remove the encroachments, it must clearly state this in an affidavit before the court.

The next hearing is set for July 3.
