NEW DELHI: Today, on June 19, the Delhi High Court has rejected the anticipatory bail request of a man who was declared a proclaimed offender in a cheating case.

The court found no special or exceptional reason to grant relief in this matter.

Justice Ravinder Dudeja passed the order while hearing the bail plea of Jagadish Das. He has been booked by the Economic Offences Wing (EOW) of the Delhi Police.

The charges against him include cheating, criminal conspiracy, and criminal breach of trust committed by a banker, merchant, agent, or someone in a similar capacity.

A person is declared a proclaimed offender when they fail to appear before the court even after a public notice or proclamation is issued.

In this case, the court observed that despite the proclamation, the accused did not appear before the investigating agency or the court, and was continuously evading the legal process.

The High Court stated clearly,

“There are no exceptional or special circumstances made out by the petitioner to grant him the benefit of anticipatory bail.”

The court also noted that the man had been avoiding investigation and had not joined the inquiry despite multiple opportunities. It emphasized that this kind of behavior cannot be encouraged.

the court observed,

“The conduct of the petitioner shows blatant disregard for the law. He has not cooperated with the investigation and remained absconding despite issuance of proclamation under Section 82 CrPC,”

Further, the court added,

“Merely because the petitioner is willing to join the investigation now cannot be a ground to grant anticipatory bail.”

After considering all the facts and submissions, the Delhi High Court concluded that granting anticipatory bail in this case would send the wrong message and undermine the seriousness of the law. Therefore, the court dismissed the plea and directed the petitioner to surrender before the authorities.

the court said,

“There is no justification to exercise the discretion in favour of the petitioner,”

rejecting the anticipatory bail plea of Jagadish Das.
