UTTAR PRADESH: The Allahabad High Court has granted relief to 240 MBBS students of G.S. Medical College & Hospital, Hapur, who challenged a mid-session tuition fee hike. The single-judge bench of Justice Chandra Dhari Singh has stayed the July 5, 2025, notification issued by the Uttar Pradesh government that increased the MBBS tuition fee from Rs 11,78,892 to Rs 14,14,670 for the 2024–25 academic session.
Background of the Case
The writ petition was filed against the State of Uttar Pradesh, the Fee Regulatory Committee, and G.S. Medical College & Hospital.
Represented by Advocates Nipun Singh and Sumit Suri, the students argued that this was the second fee hike within eight months, coming in the middle of the academic session, and was therefore arbitrary, unjust, and contrary to Section 10 of the U.P. Private Professional Educational Institutions (Regulation of Admission and Fixation of Fee) Act, 2006.
They also pointed out that:
- Miscellaneous charges had already been increased earlier in the session and paid by students.
- Their admission was based on the original fee structure published in the college’s official brochure.
- The Fee Regulatory Committee allegedly acted on a court order obtained by the institution, without fully assessing the students’ financial hardships.
College and State Government’s Stand
Counsel for the institution, Santosh Kumar Singh, opposed the plea, maintaining that:
- The fee increase complied with Section 10 of the 2006 Act.
- The Governor of Uttar Pradesh had duly approved the revised fee structure.
- The Fee Regulatory Committee was properly constituted under Section 4 of the Act, consisting of senior officials or vice-chancellors and experienced members in finance and administration.
They argued that there was a due application of mind and no illegality in the notification.
Court’s Observations and Interim Order
After hearing both sides, Justice Singh observed that the matter “requires consideration”. The Court ordered:
- Respondents to file short counter-affidavits within two weeks.
- Petitioners to file a rejoinder affidavit within one week thereafter.
- The case is to be listed on September 17, 2025, for a fresh hearing.
- Operation of the July 5, 2025, notification to remain in abeyance until further orders.
This means students will continue paying the earlier tuition fee until the court reaches a final decision.
