CHENNAI: Today(on 10th June), The Madras High Court commended the Tamil Nadu government for its initiatives to create a safe and inclusive environment for the transgender and LGBTQIA+ community through its Gender and Sexual Minority Policy. This praise was part of ongoing efforts to promote equality and inclusivity within the state.
Justice Anand Venkatesh acknowledged the significant strides made by the state government, highlighting its progressive stance in a country where traditional views often dominate. The court allowed the request of State Public Prosecutor Hasan Mohammed Jinnah for an additional three months to finalize the comprehensive policy aimed at protecting the rights and dignity of the gender and sexual minority communities.
While granting this extension, Justice Venkatesh remarked-
“This Court expresses confidence in the State’s ability to finalize and notify the policy within three months. Achieving this milestone would establish a precedent nationwide and instill hope in the LGBTQIA+ community. It’s noteworthy that this progress originates from Tamil Nadu, a state often perceived as conservative by the rest of the country.”
The judge emphasized the importance of such policies in setting a national example, reflecting the court’s optimism about the potential impact of Tamil Nadu’s initiative.
“The State of Tamil Nadu, despite being labeled relatively conservative by the nation, is commendably leading the way through this policy.”
– he said.
The court’s decision to grant additional time was based on the assurance that the policy would be finalized and implemented promptly. Justice Venkatesh’s statements underscore the significance of Tamil Nadu’s efforts and their potential to inspire similar actions across India.

“This Court expresses confidence that the State will conclude and announce the policy within three months.”
– Justice Venkatesh reiterated, reflecting his belief in the government’s commitment to the cause.
He added-
“Should this occur, it will establish a precedent nationwide and bring hope to the LGBTQIA+ community.”
Justice Venkatesh’s acknowledgment of Tamil Nadu’s progressive steps highlights a broader movement towards inclusivity and equality within the state. The court’s appreciation of the state’s efforts serves as a reminder of the importance of governmental policies in shaping societal attitudes and providing necessary protections for marginalized communities.
The Tamil Nadu High Court has directed the National Medical Commission to revise the curriculum for students of Forensic Sciences and Psychiatry to reflect the ban on conversion therapy. This directive comes in response to a petition filed in 2022 by a homosexual couple seeking police protection.
Justice Venkatesh, who presided over the case, noted that although the National Medical Commission had notified in September 2022 that –
“Under the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, conversion therapy will be deemed professional misconduct.”
This crucial change had not been incorporated into the curriculum. The Court stressed the need for immediate action, directing the Commission to ensure the curriculum was revised within three months.
Justice Venkatesh highlighted the importance of updating educational content to mirror current regulations and societal norms.
“It’s essential to incorporate the prohibition of conversion therapy into the curriculum for Forensic Sciences and Psychiatry students to prevent future professional misconduct and safeguard the well-being of the LGBTQ+ community.”
– he emphasized.
The plea, initially filed by the homosexual couple in 2022, sought police protection due to societal and familial threats. However, Justice Venkatesh extended the scope of the plea, recognizing the broader need for systemic changes to support LGBTQ+ rights. Since then, he has issued several directives to both the Tamil Nadu government and the Central government aimed at fostering an inclusive environment.
In his previous orders, Justice Venkatesh has underscored the necessity of inclusive policy changes.
“The government must enact policies to safeguard and advance the rights of the LGBTQ+ community, ensuring they are shielded from discrimination or violence.”
– he stated.
The Court’s directives have not been limited to curriculum changes. Justice Venkatesh has also called for comprehensive awareness programs and training sessions for police and medical professionals.
“Sensitization programs are vital to educate law enforcement and healthcare providers about the challenges encountered by the LGBTQ+ community, enabling them to provide improved support and protection.”

Moreover, Justice Venkatesh has advocated for the creation of safe spaces for LGBTQ+ individuals.
“Establishing safe havens where members of the LGBTQ+ community can seek assistance and support without fear of backlash or discrimination is crucial.”
– he asserted.
The Tamil Nadu High Court’s proactive approach in addressing the needs of the LGBTQ+ community has been widely lauded. Activists and community members have expressed their gratitude for the Court’s steadfast commitment to promoting equality and justice.
