Delhi High Court Jails 12 Men for Attacking Court Commissioners in Fake Samsung Phone Case: “Interference in Administration of Justice”

NEW DELHI: The Delhi High Court punished 12 men with one day in jail and a fine of Rs 2,000 each after they attacked advocate commissioners who were checking the sale of fake Samsung mobile phones in a busy Kolkata market.

The decision came from a Division Bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar, who made it clear that disturbing the work of court-appointed commissioners is nothing less than disturbing the entire administration of justice.

The judges strongly noted that if such people are not punished strictly, the law will lose its respect among common citizens.

They said this will badly harm the trust in the justice system.

The Court said:

“It is, therefore, imperative; rather, duty of the Court, to ensure that people who interfere in the administration of justice are dealt with severely so that people respect and adhere to law for the rule of law to prevail.”

This order came in a suo motu contempt case which had started in 2015.

At that time, the Court had appointed advocate commissioners to conduct checks, inventories, and seizures in a trademark infringement case filed by Samsung Electronics against fake mobile sellers.

But while they were carrying out the work with police protection, the commissioners were attacked by a mob of almost 200 people. They faced threats, resistance, and even physical assault. Several advocates and police officers suffered serious injuries in the violent incident.

Later, the Court examined the situation carefully. It noted that it was not fully clear how many from the mob of 200 actually knew about the court’s order and how many were just local bystanders who unknowingly became part of the obstruction.

Still, after investigation, the Court found 12 shopkeepers and their assistants guilty of contempt of court. These were the people directly responsible for the violence and obstruction. They were convicted and punished.
