Today, On 7th October, The Delhi High Court adjourned the bail pleas of Umar Khalid and Sharjeel Imam, key accused in the Delhi riots case, to November 25, 2024. The court cited that the justices were unavailable today, leading to the postponement. Khalid and Imam are facing charges related to their alleged involvement in the 2020 Delhi riots

New Delhi: The Delhi High Court, on Monday, postponed the hearing of bail pleas filed by Umar Khalid, Sharjeel Imam, and other individuals accused in the UAPA case concerning the alleged larger conspiracy behind the 2020 North-East Delhi riots.
The hearing deferred due to the absence of the division bench, consisting of Justice Navin Chawla and Justice Shalinder Kaur.

The bail pleas now scheduled for hearing on November 25.
The matters scheduled for a fresh hearing today before a newly constituted bench. However, since the bench did not convene, the court master assigned a new date for the next hearing.
According to the court master, the bench will not be sitting tomorrow either. The new bench expected to hear the bail pleas of Umar Khalid, Sharjeel Imam, and co-accused individuals, including Mohd. Saleem Khan, Shifa ur Rehman, Shadab Ahmed, Athar Khan, Khalid Saifi, and Gulfisha Fatima.
Khalid’s current appeal challenges the rejection of his second regular bail application. A notice regarding his bail plea issued by a division bench led by Justice Suresh Kumar Kait in August. The bail appeals for the other accused have been pending in the Delhi High Court since 2022. The new division bench has been assigned these bail appeals after previous benches either recused themselves or were unable to fully hear and decide the cases.
In September 2020, Umar Khalid arrested amidst allegations of being a central figure in the February Delhi riots. His legal ordeal has been fraught with challenges, with charges ranging from criminal conspiracy to offenses under the UAPA.
Despite seeking bail initially denied by the trial court in March 2022 and subsequently rejected by the Delhi High Court in October 2022, Khalid’s perseverance led him to take his case to the Supreme Court of India.
In May 2023, Khalid’s plea reached the Supreme Court, prompting the court to request a response from the Delhi Police. Despite this, the proceedings faced multiple adjournments, with the plea postponed on 14 occasions. On February 14, 2024, the Supreme Court scheduled to review the bail request. However, Khalid’s legal representative, Senior Advocate Kapil Sibal, opted to strategically retract the plea from the Supreme Court.

The journey of Umar Khalid’s bail plea has seen multiple stages. He decided to challenge the Delhi High Court’s judgment from October 2022, which had denied him bail. Khalid’s initial arrest executed by the Delhi Police in September 2020, where he charged with several offenses.
These charges encompassed criminal conspiracy, rioting, unlawful assembly, and other serious allegations under the Unlawful Activities (Prevention) Act (UAPA). Since that time, Khalid has been under continuous detention.
