‘Forgery Case’ Against Delhi’s First Transgender MCD Councillor Bobi Kinner: HC Grants Anticipatory Bail

NEW DELHI: The Delhi High Court today (28th Nov) granted anticipatory bail to Bobi Kinner, Delhi’s first transgender MCD Councillor, in a case related to forgery. Bobi was accused of obtaining a caste certificate using fabricated documents. Her previous anticipatory bail plea had been rejected by the trial court.

After hearing the arguments of her counsel, Praveen Kumar Duhan, and the Delhi police, Justice Amit Mahajan allowed her bail, requiring a personal bond of Rs 25,000 if she is arrested. The court also scheduled a hearing for her plea to quash the FIR in February 2025.

The trial court remarked,

“The submission of blurred and illegible documents during the application process, along with the rules violated by the authorities in Gautambudh Nagar, UP, while issuing the certificate, suggests the possibility of a large nexus involving multiple individuals.”

Earlier, The Rohini District Court recently rejected the anticipatory bail application of Bobi Kinner, a transgender MCD councillor, who is accused in a case involving a fraudulent caste certificate. The court ruled that custodial interrogation was necessary to fully investigate the matter, noting the possible involvement of a larger network in issuing the certificate. .

After reviewing the case details, Additional Sessions Judge (ASJ) Kapil Kumar denied the bail, emphasizing that the circumstances surrounding the certificate’s acquisition suggested the involvement of multiple individuals, including government officials.

The judge remarked, “The manner in which the certificate was obtained reveals the involvement of various persons at different levels,” highlighting the need for Kinner’s custodial interrogation to uncover the full facts and evidence.

The court’s October 4 order underlined the necessity for further investigation, pointing out issues with the application process, such as the submission of blurred and illegible documents and violations of procedural rules by authorities in Gautambudh Nagar, Uttar Pradesh. This raised suspicions of a wider nexus in the fraudulent issuance of the caste certificate.

Additionally, the court criticized Kinner for not fully cooperating with the investigation, noting her failure to provide crucial documents despite having received interim protection from arrest for over a month.

Kinner had initially applied for anticipatory bail on August 23, when she was granted temporary protection from arrest on the condition of cooperating with the investigation. Her counsel argued that the FIR was baseless and filed through a misuse of legal provisions.

The complainant’s lawyer and the Additional Public Prosecutor, however, argued that the FIR was filed after reviewing conflicting reports about the same certificate, further justifying the need for custodial interrogation.
