During Friday’s proceedings, a bench comprising Justice Tapabrata Chakraborty and Justice Reetobroto Mitra examined two habeas corpus writs. One case involved a father, mother, and their eight-year-old son allegedly deported to Bangladesh, while the other concerned their close relatives another father, mother, and minor son.
The petitioners’ counsel informed the bench that they learned about the alleged deportation through media reports. The representative for the West Bengal Government present in court supported this assertion.
Claiming that the “deported” individuals were Indian citizens, the petitioners’ counsel noted that they had emailed the Delhi Police, providing evidence of the individuals’ citizenship and urging the authorities to retrieve the relevant identity documents from the detainees.
The counsel stated,
“The reply is still awaited,”
The counsel further argued that the three individuals were allegedly deported to Bangladesh without being presented before the Foreigners Tribunal, as required by law.
Counsel for the other three individuals, including a minor son from Birbhum, stated that these relatives were also reportedly deported to Bangladesh after being picked up from the Rohini Police Station area in Delhi.
Justice Chakraborty remarked that the bench had issued an order on Thursday and would be directing similar actions to the state.
The petitioners’ counsel also highlighted that some individuals seeking the court’s protection were still in India, specifically in Odisha.
