Delhi Excise Policy Case | Delhi High Court Allows Sameer Mahendru to Travel to UAE for Business

New Delhi: The Delhi High Court on Thursday (Jan 23rd) permitted Sameer Mahendru, an accused in the Delhi Excise Policy case, to travel to the UAE for business purposes from January 28 to January 31, 2025. Currently out on regular bail, Mahendru sought this approval to attend important business commitments.

Justice Vikas Mahajan granted the permission after considering arguments from Mahendru’s legal counsel and the Enforcement Directorate (ED). Advocate Dhruv Gupta, appearing for Mahendru, represented the petitioner during the hearing.

Application Details:

The petition sought:

  1. Permission to travel abroad from January 28 to January 31, 2025.
  2. Access to his passport, currently in the custody of the trial court.
  3. Suspension, withdrawal, or cancellation of any Look Out Circular (LOC) issued against him.

The application highlighted that Mahendru had been granted regular bail in September 2024. He had previously been allowed to travel to Dubai from January 9 to January 16, 2025, to visit his elderly and ailing father-in-law, who resides in the UAE.

Mahendru assured the Court that he had consistently adhered to all bail conditions. His petition emphasized:

The petition further pointed out that another co-accused in the same case, Gautam Malhotra, had been permitted to travel abroad during his trial, with the LOC against him suspended during that period.

Earlier this month, Mahendru had filed a petition seeking permission to travel to Dubai with his family. This was to visit his father-in-law, whose health was reported to be deteriorating. The Court had granted this request on January 7, 2025, allowing him to travel from January 9 to January 16, 2025.

Case Background

Sameer Mahendru is one of the accused in the Delhi Excise Policy case, which has been under investigation by the Enforcement Directorate. As part of his bail conditions, Mahendru is required to obtain prior approval from the Court before leaving the country.

After reviewing Mahendru’s compliance record and considering the necessity of his travel, the Court granted permission for this short trip. Justice Mahajan ordered that Mahendru’s passport be released from the custody of the trial court and instructed authorities to suspend or cancel any Look Out Circulars that may obstruct his travel plans.

This decision highlights the importance of balancing the rights of individuals with ongoing legal proceedings, particularly when the accused has demonstrated adherence to court-mandated conditions.

Advocate Dhruv Gupta represented the petitioner, ensuring his business obligations abroad would not face undue hindrance while maintaining his commitment to the judicial process.
