NEW DELHI: The Delhi High Court issued a restraining order against well-known motivational speaker Vivek Bindra and his entrepreneurial education enterprise, Bada Business Pvt. Ltd. This order prevents them from falsely associating with Dr. Arvind Lal, the esteemed founder of Dr. Lal PathLabs. The injunction was handed down by Justice Anup Jairam Bhambhani on May 20, emphasizing the importance of truthful representation in business endorsements.
The court’s decree mandates that Vivek Bindra and his company immediately cease the use of Dr. Lal’s name, photograph, or likeness in any business-related context. This comprehensive ban extends to all forms of advertising and promotional materials where Dr. Lal’s endorsement might be implied.
Justice Bhambhani specifically ordered–
“The defendants must promptly remove and delete all advertisements, promotional materials, statements, brochures, etc., from their website and social media platforms that imply any connection between the plaintiff and the defendants. This action must be completed within one week.”
This ruling came about as a result of a lawsuit initiated by Dr. Lal against Bindra and Bada Business, asserting that there was no formal agreement or partnership between them. The claim highlighted a concerning misuse of Dr. Lal’s reputation to promote Bada Business’s initiatives, particularly their educational offerings under the misleading banner ‘Bada Business – An Initiative by Dr Vivek Bindra’.
According to the lawsuit, Bada Business misrepresented Dr. Lal as one of the ‘Bada Business Professors,’ suggesting that he would conduct lessons and lectures for a one-year Diploma course in entrepreneurship offered in collaboration with GLA University in Mathura. The course, priced at ₹49,000 plus GST, purportedly included Dr. Lal in their list of professors for the year 2023.
Dr. Lal clarified his limited involvement with Bindra’s enterprise, stating–
“I participated in a single webinar hosted by Bada Business upon invitation, where I addressed students of GLA University. However, I have not been involved with the defendants’ business in any capacity since then.”
The plaintiff also expressed concerns over his name being used as part of the ‘Professors of Billionaire Blueprint’ and his case study being cited in the course materials, which could mislead potential students and the public about his role and endorsement.
Legal representatives Mumtaz Bhalla and Tabish Samdani advocated for Dr. Lal, presenting a compelling case that emphasized the unauthorized use of his identity. The defendants, meanwhile, did not appear in court to contest the claims.
