New Delhi: The Delhi High Court on Wednesday (Jan 15th) dismissed the bail plea of gangster Neeraj Bawania in connection with the brutal 2015 murder of two prisoners inside a jail van. The case highlighted the shocking brazenness of the crime, which occurred within the confines of a closely guarded vehicle under police watch.

Justice Anup J Bhambhani, while rejecting Bawania’s bail application, remarked that the crime demonstrated “exceptional brazenness, audacity, and depravity.” The Court expressed concern over the inability of armed guards to prevent the murders, raising questions about the failure of security measures.

“For reasons which are very hard to fathom, the armed guards in the jail van were unable to prevent the murders. What these circumstances betray is not just the horror of a double murder committed under the watch of armed police guards, but also unashamed brazenness and menacing brutality on the part of the perpetrators of the crime,”

the Court observed in its judgment.

Neeraj Bawania argued for bail on the basis of delays in his trial, citing Article 21 of the Constitution, which guarantees the right to a speedy trial. However, the Court dismissed this contention, emphasizing that Article 21 is not a “free pass” to demand bail regardless of the nature of the crime and the accused’s criminal history.

Justice Bhambhani highlighted that the severity of the allegations and the gangster’s prior record did not warrant the granting of bail.

At the same time, the Court urged the trial court to expedite proceedings and “conclude the trial in the present case without any further delay.”

According to the prosecution, the incident occurred while Neeraj Bawania and the two victims were being transported from the Rohini Court lock-up to Tihar Jail in a jail van. Bawania allegedly attacked the victims, bringing them to the floor of the vehicle and strangulating them with “gamchas” (cloth towels).

This gruesome crime, committed under heavy police escort, underscores the audacity of the perpetrators and the lapses in jail security.

The Court’s decision to deny bail reflects the gravity of the offense and the importance of ensuring justice in cases involving such heinous acts. The ruling also sends a strong message about the consequences of misuse of judicial safeguards by individuals with a history of violent crimes.
