NEW DELHI: In Delhi High Court, Justice Purushaindra Kumar Kaurav today directed Congress leader Pawan Khera to make important changes in his defamation case filed against Republic TV anchor Arnab Goswami.
The case relates to comments made by Goswami during a news broadcast aired in May, at the time of heightened tension between India and Pakistan.
During the hearing, Justice Kaurav asked whether Pawan Khera was filing this case personally or on behalf of the Congress party. Khera’s lawyer clarified that,
“The suit has been filed in my personal capacity, holding the position of Chairman within the political party.”
Justice Kaurav responded that the Court needed clarity on how the statements made during the show personally defamed Khera.
The judge asked the counsel,
“Explain how this amounts to defamation.”
The lawyer argued that the comments made on the show implied that the Congress party was siding with the enemy nation. The lawyer pointed out that the broadcast included a line saying,
“As of now the party is with the nation’s enemy,”
and further questioned,
“Are Congress voters also enemies of the nation?”
Hearing this, the Court questioned again:
“Since you’ve filed the case in your personal capacity, point out where exactly the remarks specifically target you as an individual.”
The lawyer maintained that Khera was filing this case as an individual but also held an important official role within the Congress party.
The Court, however, was not fully satisfied with the current version of the case filing. Justice Kaurav clearly stated,
“The plaint must be properly modified; we cannot go on like this.”
To this, the lawyer replied,
“We will carry out the necessary amendments.”
Justice Kaurav also noted that changes must be made in the memo of parties and said,
“The memo of parties should also be corrected to reflect representation in an official capacity.”
As a result, the Court decided that the next hearing will be scheduled only after the revised version of the case (called the “amended plaint“) is properly submitted by Pawan Khera’s legal team.
