Central Government Assures Delhi High Court of Medical Care for Yasin Malik

The Central Government has committed to providing necessary medical treatment to Yasin Malik, a decision that was officially recorded by the Delhi High Court. This assurance comes amidst concerns over Malik’s health, specifically regarding his cardiac and kidney conditions.


During the proceedings before Justice Anoop Kumar Mendiratta, Advocate Rajat Nair, representing the Union Government, stated,

“Learned counsel for the respondent (Union of India) submits that they are duty bound to provide necessary medical treatment to the petitioner (Malik) as and when required in accordance with law.”

This commitment was duly noted by the court, highlighting the government’s acknowledgment of its responsibility towards ensuring Malik’s health needs are met in compliance with legal standards.

Presently, Malik is undergoing life imprisonment for his involvement in a case related to funding terrorism. Nonetheless, the National Investigation Agency (NIA) has taken steps to appeal to the high court for the imposition of the death penalty. The case is currently awaiting deliberation by a division bench of the high court.

The JKLF militant was found guilty on May 19, 2022, in relation to a case involving funding terrorism and advocating for secession in Jammu and Kashmir. The verdict was delivered on May 25, 2022, by NIA Judge Praveen Singh, who sentenced Malik to life imprisonment along with a fine of Rs. 10 lakhs.

The case reached the Delhi High Court following a plea by Malik, seeking intervention to receive medical treatment at the All India Institute of Medical Sciences (AIIMS) for his ailments. The court, having previously requested a status report from the government on Malik’s health condition, moved to dispose of the plea in light of the government’s assurance.


The court was informed of an incident on February 13, where Malik experienced dizziness, prompting an immediate medical examination by jail authorities. Advocate Nair disclosed that the examination revealed Malik had ceased taking his prescribed medications voluntarily. Following this discovery, Malik was promptly taken to AIIMS, where he received the necessary medical attention.


The disposition of Malik’s plea by the Delhi High Court, following the government’s assurance, underscores the judiciary’s role in overseeing the welfare of prisoners, ensuring they receive appropriate medical care. Malik’s counsel expressed no objections to the plea’s disposal, provided the government’s commitment to Malik’s health care is upheld.

This development not only addresses the immediate health concerns of Yasin Malik but also sets a precedent for the treatment of prisoners with serious health issues, affirming the state’s obligation to provide medical care in accordance with the law.

As the case concludes, it reinforces the importance of legal oversight in the protection of prisoners’ rights, particularly in matters concerning their health and well-being.
