Justice Sameer Jain’s bench noted Riyaz’s lack of a criminal record beyond this case and the relatively short maximum punishment. The court, without opining on the case’s merits, considered Riyaz’s apology and granted bail.

Ovaisi arrested on January 28, 2024, following a case filed against him under Sections 153-A, 295-A, 505(2) of the IPC, and Section 67 of the IT Act at Sureri Police Station in Uttar Pradesh’s Jaunpur district.
Ovaisi’s lawyer emphasized his innocence and respect for Hinduism, seeking relief for his client. The case, registered in Jaunpur district, Uttar Pradesh, sparked debates about religious sensitivities and legal freedoms. Ovaisi’s lawyer claimed that a friend used his Facebook account and that Ovaisi apologized to the police. The lawyer argued that the country’s secular fabric strong enough not to be disrupted by false messages.
The high court acknowledged that an offensive message sent from Ovaisi’s account but noted his clean criminal record. The court emphasized the robustness of India’s secular values despite such incidents.
