The Delhi High Court has refused bail to former AAP councillor Tahir Hussain, accused in the murder of IB officer Ankit Sharma during the 2020 northeast Delhi riots. The court said Hussain played the role of an instigator and must face trial under multiple IPC sections.
New Delhi: The Delhi High Court on Thursday refused to grant bail to former Aam Aadmi Party (AAP) councillor Tahir Hussain, who has been accused in the murder of Intelligence Bureau (IB) officer Ankit Sharma.
Justice Neena Bansal Krishna passed the order, rejecting the bail plea of Hussain.
Ankit Sharma was killed during the February 2020 northeast Delhi riots. His body was later found in a drain, and the Delhi Police, in its chargesheet, stated that he had suffered multiple stab injuries.
During the investigation, the police alleged that Sharma was specifically targeted by a mob that dragged him into a house in Jaffrabad. The chargesheet named a group of accused, including then-AAP councillor Tahir Hussain, in connection with his murder.
In March 2023, Delhi’s Karkardooma Court formally framed murder charges against Tahir Hussain and 10 others in the case.
Additional Sessions Judge Pulastya Pramachala, while reviewing the evidence, stated that Tahir Hussain had played the role of an instigator, encouraging the mob to attack Hindus.

The Judge said Hussain had exhorted the crowd to “not spare Hindus.”
The Court observed that Hussain and other accused are liable to be tried under multiple provisions of the Indian Penal Code (IPC).
These include Sections 147 (Rioting), 148 (Rioting, armed with deadly weapon), 153A (Promoting enmity between different groups on grounds of religion, race, place of birth, residence), 302 (Murder) read with 120B (Criminal Conspiracy).

Tahir Hussain was represented by advocates Rajiv Mohan, Tara Narula, Shivangi, Hamendra, Sonal, and Shreya Sharma.
The Delhi Police, on the other hand, was represented by Special Public Prosecutor (SPP) Rajat Nair and Advocate Dhruv Pande.
The High Court’s decision to deny bail reinforces the serious nature of the allegations against Hussain and underscores the ongoing investigation and trial for one of the most significant cases linked to the 2020 northeast Delhi riots.
