The Lucknow bench of the High Court, led by Justice Subhash Vidyarthi, rejected Rahul Gandhi’s plea against a summons issued over his Army comment case. A detailed order will be released by Monday.

The Allahabad High Court dismissed Congress leader Rahul Gandhi’s petition , which challenged a trial court’s summons and complaint regarding his alleged derogatory comments about the Indian Army made during his Bharat Jodo Yatra.
A bench in Lucknow, led by Justice Subhash Vidyarthi, issued the ruling and noted that a detailed order would be released by Monday.
In opposing Gandhi’s plea, a team of state lawyers, including additional advocate general VK Shahi, government advocate VK Singh, and additional government advocate Anurag Verma, argued that the petition was not maintainable in the high court, as the petitioner had an alternative remedy to contest the summoning order in the sessions court.
They further argued that a preliminary review of the complaint and witness statements indicated that a prima facie offense had been established against him.
Gandhi contested the summoning order and the complaint, asserting that it was driven by malice and lodged with ulterior motives.
In his plea submitted to the court, complainant Udai Shanker Srivastava claimed that during the December 2022 Yatra, Gandhi made multiple derogatory remarks concerning the Indian Army in relation to the conflict with Chinese soldiers.
The lower court subsequently summoned Gandhi as an accused to stand trial.

Gandhi’s attorney, Pranshu Agarwal, contended that the allegations seemed fabricated based solely on the complaint’s content.
He also argued that since Gandhi is not a resident of Lucknow, the lower court should have verified the validity of the allegations before summoning him.
He asserted that Gandhi should have been called only if the allegations were found prima facie suitable for trial.
