Uttar Pradesh: In a significant development in the ongoing Krishna Janmabhoomi-Shahi Idgah Masjid dispute, the Allahabad High Court has decided to consolidate fifteen of the eighteen suits filed in relation to the case. This decision was made to ensure a more efficient legal process, aiming to save court time, reduce expenses for the parties involved, and prevent the possibility of conflicting judgments.

The plaintiff’s counsel highlighted that these cases were initially presented before the Civil Judge (Senior Division) in Mathura on September 25, 2020, before being transferred to the High Court. Acknowledging the similarities in the nature of these suits, the Court, in its order dated January 11, stated,

“These suits are of similar nature. The proceedings in these suits can be taken up and the suits may be decided simultaneously on the basis of common evidence. To save the time of the Court, the expenses to be incurred to the parties, and to avoid conflicting judgments it appears expedient in the interest of justice to consolidate the suits with each other.”

Regarding the three remaining suits, the Court mentioned that the decision to consolidate two of them would be made at a later stage. The Court elaborated,

“So far as the Suit No. 10 of 2023 is concerned an application for restoration of the suit is pending… Since, in Original Suit No. 17 of 2023, an application under Order I Rule 8 read with Section 151 C.P.C. is pending for disposal, therefore, the issue of consolidation of this suit with another suits will also be taken into consideration later on.”

The final suit, which is filed against the Union of India and not private defendants, was noted separately by the Court.

This consolidation marks a pivotal step in the legal proceedings surrounding the Krishna Janmabhoomi-Shahi Idgah Masjid dispute, a case that has garnered significant attention and is deeply rooted in historical and religious contexts.

The High Court’s decision to hear these suits together is expected to bring more coherence and efficiency to the adjudication process of this complex and sensitive matter.
