AAP Worker Death Case|| “No Offense Was Established”: Delhi HC Dismisses Revision Petition Seeking FIR Against Kejriwal & Others

The Delhi High Court dismissed a plea seeking the registration of an FIR against Chief Minister Arvind Kejriwal in connection with the death of an AAP worker. The petitioner accused Kejriwal of being involved in the incident. However, the court found no substantial grounds to warrant an FIR and rejected the plea.

New Delhi: The Delhi High Court dismissed a revision petition filed by Kalawati, the mother of former AAP worker Santosh Koli, challenging a trial court’s decision that rejected her request for an FIR registration concerning her daughter’s death in 2013.

The case involved allegations of a political conspiracy implicating former Chief Minister Arvind Kejriwal, ex-AAP leader Kumar Vishvas, and other party members.

Justice Neena Bansal Krishna rejected the plea, upholding the trial court’s ruling from last year, which denied Kalawati’s application to register an FIR under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989. The court stated that the allegations did not justify invoking the Act.

The High Court ruled that while Kalawati’s complaint suggested a conspiracy to murder her daughter, it lacked specific caste-based abuse or remarks required under the Act.

Justice Krishna noted,

“The trial court Judge correctly determined that no offense under the Act was established based on the complaint, which led to the rejection of the FIR application.”

Consequently, the court found no merit in Kalawati’s petition and dismissed her claims.

Kalawati, a 60-year-old woman, filed a petition claiming that her daughter, Santosh Koli, was murdered as part of a political conspiracy. Despite her complaint to the police, no FIR registered for the murder or related offenses under the SC/ST (Prevention of Atrocities) Act. Her application, filed under Section 156(3) of the Cr.P.C., dismissed by the Additional Sessions Judge on September 16, 2023, which led her to file a revision petition.

Kalawati highlighted that her daughter, Santosh Koli, who worked closely with Arvind Kejriwal at the Parivartan Institution, a courageous individual and had been honoured with a Bravery Award by former President Dr. Abdul Kalam.

She claimed that Santosh was forced to accept a ticket to contest the Delhi Assembly Elections, and specific individuals were appointed by Kejriwal to help her during the campaign.

The family of Santosh Koli, an AAP member who tragically died in a road accident in 2013, has long alleged that her death was a murder. They criticized the AAP for failing to investigate the case. Kalawati also accused Chief Minister Arvind Kejriwal of knowing about the death threats Santosh had received but claimed he took no action to protect her daughter.
