Gujarat: The Gujarat High Court on Thursday(7th Nov) denied temporary bail to Faruk Mohammad Bhana, who is serving a life sentence for his role in the 2002 Godhra train burning incident.
BRIEF FACTS
Bhana, a key conspirator in the attack that killed 59 people, sought temporary release to care for his 95-year-old father, who is undergoing medical treatment. Justice Sanjeev J Thaker dismissed the request, noting that other family members are available to tend to Bhana’s father and that Bhana had recently been granted an 8-day bail period.
The Court remarked, “The jail records show that the applicant was convicted under Section 302 of the IPC and sentenced to life imprisonment. Given that other family members can care for his father and the recent bail grant, no case is made out, and the application is rejected accordingly.”
Bhana’s lawyer argued that he sought bail to manage his father’s medical care, as the father suffers from diastolic dysfunction and kidney issues. The State’s counsel opposed the plea, emphasizing that other family members can provide necessary support and that Bhana had recently received temporary bail.

Bhana, arrested by the Anti-Terrorist Squad (ATS) in 2016 after evading capture for 14 years, was implicated in the conspiracy to burn the Sabarmati Express coach S-6 with other accomplices. ATS officials reported that Bhana, a former corporator in Godhra, fled to Mumbai to avoid arrest.
The 2002 Godhra train burning triggered widespread communal violence across Gujarat, resulting in approximately 2,000 fatalities.
