"Economic Prosperity and Individual Rights: Complementary Forces, Not Mutually Exclusive": Justice Hima Kohli

NEW DELHI: Recently, Supreme Court judge Hima Kohli highlighted that the Indian judiciary recognizes the importance of sustainable approaches to economic development. Speaking at the American Bar Association (ABA)-India Conference 2024, Justice Kohli emphasized the judiciary’s increasing inclination towards endorsing sustainable growth models.

By upholding laws and principles that advocate for sustainability, the Indian judiciary reinforces the idea that lasting economic prosperity is intertwined with environmental protection and social well-being.

Justice Kohli emphasized-

“The Indian judiciary adopts a holistic approach, recognizing that genuine economic progress entails sustainable strategies that serve the broader interests of society, rather than focusing solely on short-term gains.”

In India, the judiciary recognizes that economic well-being and individual rights are mutually reinforcing, fostering a fairer and more prosperous society when balanced effectively.

Justice Kohli further elaborated-

“This judicial approach recognizes that economic prosperity and individual rights are not mutually exclusive but rather complementary forces. When balanced appropriately, they contribute to a fairer, more equitable, inclusive, and prosperous society.”

Recognizing the potential for collaboration between India and the United States, especially in terms of judicial cooperation and mutual respect for the rule of law, Justice Kohli emphasized that it offers a tremendous opportunity to enhance economic development.

She stated-

“By prioritizing legal certainty, prompt dispute resolution, property rights protection, contract enforcement, and digital transformation, both nations can cultivate a conducive environment for economic growth and innovation.”

From India’s perspective, learning from the US experience and fostering closer judicial and legal cooperation will not only benefit our economic ties but also strengthen the very foundation of our democratic and legal systems.

Justice Kohli highlighted the significance of this partnership, stating-

“India can benefit from the US experience by fostering closer judicial and legal cooperation, which will not only enhance economic ties but also reinforce the foundations of our democratic and legal systems.”

The Indian judiciary’s recognition of the interplay between sustainable development, economic prosperity, and individual rights marks a progressive step towards a more holistic approach to governance. By upholding laws that prioritize environmental conservation, social welfare, and the protection of individual rights, the judiciary lays the groundwork for a future that balances the needs of society with long-term economic growth.
