Only eight of 26 prosecution witnesses had been examined, and their recall would prolong proceedings further. Delhi High Court granted regular bail to an NDPS accused detained since December 2021.

New Delhi: Justice Girish Kathpalia allowed Harikrishnan PS’s bail application on November 2, finding no justification for further detention amid a trial unlikely to finish soon [Harikrishnan PS v. Narcotics Control Bureau].
Delay conceded by NCB
NCB accepted that the applicant had not caused the delay. The alleged recovery involved commercial quantities, attracting Section 37’s stringent bail conditions.
Paragraph 8 recognised that speedy-trial considerations can qualify those restrictions. The Court noted that a co-accused had already obtained bail for delay; witnesses also required recall following another accused’s later arrest.
Release on bond
Paragraph 9 ordered release against a Rs 50,000 personal bond and one surety for the same amount. This decides bail, not guilt.
